One of my employees (unmarried and whose parents have already died) covered under ESIC met with an accident and died. He has one sister (21 years old, unmarried, and totally dependent on my employee's income), one brother (24 years old, married, living separately, and not dependent on my employee's income), and a maternal grandmother (85 years old and completely dependent on my employee's salary). The ESIC claim was approved for the maternal grandmother by HO, but the process was stopped midway, stating that the maternal grandmother cannot receive the benefit. Is this true? If so, who is eligible for the claim?

The reply to the question is that it is eligible for her sister. There is a possibility for her sister to claim it if she is studying. However, if she is an employee, she is not eligible.

1. Sir, you have not mentioned whether the said employee had an insurance number and an identity card under the ESI Act.

2. Kindly also provide information on the reasons for the employee's death. Was the employee's death a result of any employment injury occurring during the course of employment?

You simply need to buy the Maharashtra State Rules of the Employees' State Insurance Act 1948, and you will find all the answers regarding "who is responsible for an Insured Person." The ESI Corporation is a social security organization, and they do not act out of vindictiveness towards any member to prevent them from receiving reasonable benefits. They operate based on the rules, not emotions.

Sir, the ESI Act of 1948 is administered by the Central Government. Therefore, there are no "Maharashtra State Rules of Employees State Insurance Act, 1948" that may be applicable in the situation raised by one of the members.
