Notice Period for Employment Under Six Months

If there is no mention of a notice period to be served before being relieved in the offer letter, what should be the minimum notice if the tenure of employment is less than six months?

Handling Non-Cooperative Employees

What if the employee is not cooperative in the relieving process? Additionally, what if the employee is not ready to pay the Full and Final (F&F) settlement?

You are mentioning the terms of an offer letter. What is contained in the appointment letter will take precedence over the terms and conditions mentioned in the offer letter. Please check the appointment letter for the clause of termination.

If the employer is not ready to relieve, it is still your choice to continue or to quit. As the tenure is less than 6 months, the amount of F&F would be very less. Compare it with what is the gain in the new employment and take a conscious decision.

If the appointment letter is silent with respect to notice, it shall be presumed that the services can be terminated without notice. Therefore, the employee is in a position to leave the organization without notice. Moreover, with the period of service being six months, the employer is also under no obligation to give notice if the employer wants to terminate the employee.

As per the Standing Order, the probation will be 3 months. If you want to extend, you can do so for another 3 months. After completing 6 months or 240 days of actual work, the person will be eligible for permanent status.

Now, regarding the notice period, during the probation period, you can leave your job at any time. However, upon becoming permanent, you would need to serve a notice period of 15 days to 1 month (some companies may have a 3-month notice period). Note that the offer letter may not specify your notice period; instead, the appointment letter will include details such as salary, transfers, notice period, standing orders, etc.

If your appointment letter does not mention a notice period, you are free to leave the job at any time.
