Termination of services should be a last resort, and you must complete the paperwork before termination, showing various aspects of non-performance if necessary as a backup in a legal case. The best approach is to ask the employee to resign with respect to their non-performance.

Sending dismissal papers to an employee on authorized leave is unethical. The company will face difficulties in explaining its dismissal process.
