Leaving After a Few Months: Can I Withdraw My Full PF Amount? Seeking Advice!

I am working with an MNC organization for the last three months. I have just resigned, and by my last working day, my duration with this company will be 4 months and 5 days.

Question About PF Amount

Can I get my PF amount fully? I heard that if someone leaves a company after about 3 months, they can only get the PF contribution amount and not the pension contribution amount. Is this true? Your valuable suggestions will be appreciated.

You will only receive the PF contribution; the pension amount will be provided if you contribute for at least 6 months.

Thank you, Sir. I have one more question regarding the same topic - the PF contribution is 3.67% on basic, but what would be the employer's contribution for the PF amount (i.e., are there any administrative charges included or not)?

- 3.67% from the employer's side
- 1.10% administrative charges on the PF contribution.

Is this the correct calculation for PF only?

For pension, a minimum of 10 years' service is required. If the service is less than 10 years, a one-time withdrawal benefit can be claimed, subject to a minimum service of 6 months. If the service is even less, the pensionable service can be transferred to club with future service. A Scheme Certificate can also be applied for.

Mr. Khanna is right. You can withdraw your EPF accumulation only, not EPS. Rather than withdrawing, get your accumulation transferred.

Okay, it means I can transfer my PF to a new account. Sir, the thing is, my PF number is from Maharashtra, and my new PF number would be from Gurgaon. So, will there be any problem transferring this PF amount to the new account?

You have the full right to the amount, whether you or your employer contributed towards the PF account, whether it is for 3 months or for 1 day. Regarding the pension, you must complete 6 months in one organization to avail of the pension scheme.

Transferring the PF

Transferring the PF is not an issue. Submit Form 13 to your current employer, and they will take care of the rest.

Hi all, I still have one point that is unclear to me: If I complete the PF transfer process, will my pension amount also be transferred? Alternatively, if I fill out Form No. 13, will both my PF and pension amounts be transferred to the new PF account?

He has to submit Form 19 to the HR Department, and then the form must be forwarded to the PF office for further necessary processing.

For exempted PF Trusts and Insurance Policy in lieu of EDLI, there will not be any admin charges.

In my reply, I have only corrected Mr. Amol as he mistakenly posted 3.67% as the employee contribution. However, he posted the admin charges correctly, so no correction is required for that.

Regarding EDLI, he didn't raise any queries.

Dear Amol, Let me give you a specific answer to your question. Your service is 4 months and 5 days.

PF Contributions

- Employee 12%: This amount fully goes into Account No.1 called PF.
- Employer 3.67%: This also goes into Account No.1.
- Employer 8.33%: This goes into Account No.2 Pension Fund.

Options for Your Service of 4 Months and 5 Days

A) If you wish to withdraw, you will receive amounts (a) + (b) as stated above. Amount (c) will be forfeited. The withdrawal form is allowed after 60 days from the last working day.

B) You can transfer your account to a new employer in Gurgaon by submitting Transfer Form-13 through your next employer there. If you transfer, all items (a), (b), and (c) above will be transferred. Please note that inter-state transfers may take some time. These days, EPF transactions are done online, and your next employer can assist you.

The employer cannot hold the PF of any employee in any case. In a normal scenario, when an employee resigns from the organization, the employer processes Form 19 to submit the employee's details to the PF office. In your situation, the employee can have his Form 19 certified by the local authority (Sarpanch) for identification.

Yes, we can withdraw our PF and Employee Pension Fund amount. For PF withdrawal, fill out Form 19 for PF and Form 10 for EPF, and attach the same. In the case of withdrawal, the amount will be transferred to the bank account you provide in the form. Normally, it will take around six months to complete the transaction as part of the procedure to be done through the PF office.

The PF office will not give you a new PF account every time you change your company. The same account will be maintained by your current employer.

The organization where I was working started only 10 months ago. The company began deducting PF from employees' salaries without opening PF accounts. I quit the organization after 3 months and 15 days. Can I withdraw my PF as the account is still not opened? The accounts team said I am not eligible for any amount as I have not completed 6 months in the organization. Should I file a complaint of fraud against the company for deducting amounts without account opening and denying to give money?

If service is less than 6 months, only the PF amount can be withdrawn. The pension amount lapses. Kindly refer to the EPS scheme 1995.

Determination of Eligible Service

The eligible service shall be determined as follows:

(a) In the case of a "new entrant," the "actual service" shall be treated as eligible service. The total actual service shall be rounded off to the nearest year. The fraction of service for six months or more shall be treated as one year, and the service less than six months shall be ignored.

Explanation:

In the case of employees employed seasonally in any establishment, the period of "actual service" in any year, notwithstanding that such service is less than a year, shall be treated as a full year.

(b) In the case of the "existing member," the aggregate of actual service and the 'past service' shall be treated as eligible service.

Provided that if there is any period in the "past service" for which the contributions towards the Family Pension Scheme, 1971 have not been received, the said period shall count as eligible service only if the contributions thereof have been received in the Employees' Pension Fund.

Explanation: For the purpose of this sub-paragraph, the total past service for less than six months shall be ignored, and the total past service for six months and above shall be rounded to a year.

I have a UAN number attached to two companies. In the first company, I have been working for 2 years, and in the second one for 5 months. When I tried to withdraw my PF amount, the PF officer informed me that I can only withdraw from one company's PF account. Why is this the case? Please help me.

EPFO is providing a facility to the members to merge their previous EPF accounts with their current one for the integration of all previous accounts with the current UAN activated EPF account. I worked at my first company for 3 years and at my second company for 5 months. I transferred my EPF old account to a new account. I submitted my claim online for PF final settlement, which was processed within 25 days. However, when I tried to claim my pension withdrawal (Form 10C) online, it showed an error stating, "Service is less than 6 months and more than 10 years."
