Can I Claim My Full CTC After Leaving the Company? Seeking Advice on Bonus and Leave Deductions

SHIELA SHETTY
Dear Friends,

I would like to know if I can claim the amount which is included in the CTC. For example, I had requested a package of 4.5 lakh per annum, which amounts to 37,500 rupees per month. The company, in the appointment letter, stated 4.5 lakh (Incl. Bonus and Leave encashment), but my take-home salary is 30,000 per month as they are deducting 2 months' bonus and 1 month's leave from my salary.

Now that I have left that organization, please tell me whether I can claim that amount or not.

Regards,

All that depends on the clauses mentioned in your appointment letter. If you can upload the same, then members can give a suggestion.

Hi,

It all depends on the terms and conditions of your appointment letter. If you could review your appointment letter and the service rules applicable to your category of employment within your organization, you will find them applicable.

Deduction of 2 months' bonus and one month's salary from your pay is as per the clause of your appointment letter. If you discover anything contradictory to the appointment letter, you can always raise the matter, or you may approach the concerned authority under the law.

Ms. Sheela Shetty,

I agree with Mr. Maheswar Rao. You can only fight based on the terms of appointment.

Dear Sheela,

I am sorry to say, but your company is right on target with the offered CTC. CTC stands for Cost to Company, which represents a comprehensive statement of all expenses incurred by a company on its employees in a year. The CTC encompasses PF, GPA, Bonus, Leave encashment, and PLI, among others.

Upon analyzing the CTC amount, I realized that your company's calculations are accurate. My only query is regarding the duration of your tenure with the company. Considering your monthly pay of 37500, I presume they will be deducting the following amounts each month:
- PF: Rs. 2025 (approximately, based on the assumption that the basic salary is 45% of the gross salary, a common industry standard)
- Leave Encashment of 30 PLs: Rs. 3083
= 37500 - (3083 + 2025) = 32392

There remains a balance of Rs. 2392, which I assume may account for bonuses, PLI, medical insurance premiums, income tax, FBT, or other components. Please feel free to reach out for any clarifications.

I express my condolences for the difficulties you have faced.

Warm regards,
Umesh Chaudhary
