If a company has decided on retrenchment or layoff, it is of no use to fight with the management as the provisions are provided in the laws for Retrenchment and Layoff. However, you do have the right to ask for the Layoff pay or Retrenchment compensation. First, it is not clear whether it is layoff or retrenchment. Layoff is a temporary denial of a job while retrenchment is a permanent denial of a job. If it is a layoff, ask for the monthly layoff compensation, which is 15 days' salary every month. If it is retrenchment, do ask for the Retrenchment compensation, which is 15 days' salary for each completed year of service or any part thereof in excess of six months. If your company is going for retrenchment, please remember the rule of LAST COME FIRST GO. This means that those employees who joined last will be retrenched first. So, if there are employees who joined after you, they should be retrenched first.
