Hi, I would like to know the following regarding the deployment of contract labour (in an organization where Central rules apply):

1. What is the effect of a principal employer not taking a labour licence, even if the contractor is registered in the Labour Department from another organization and the licence is valid?
2. Upon a change of principal employer by the contractor, is it mandatory to inform the labour department? In this condition, is the contractor required to obtain new registration from the labour department under the new principal employer?
3. How much penalty can be imposed on a principal employer who fails to register with the labour department?
4. Can a contractor registered with the State Labour Department work in an organization where Central rules apply?

Please help me with the above.

Registration Under the Contract Labour Act

The principal employer is required to get their organization registered under the Contract Labour Act. The principal employer can then assign work to a contractor by issuing Form V for labour license registration. If the contractor changes the principal employer, then the contractor is required to obtain a fresh labour license.

If one contractor is deploying laborers for different organizations, i.e., more than one principal employer, does he have to take a separate license for each organization (PE), or can he obtain one common license for deploying contract labor in all different organizations?

Is it possible for one contractor to obtain a general license to work with more than one Principal Employer (PE)? For example, working with one PE for a few months and then with another PE for a few other months, or possibly working with both at the same time.
