Navigating PF Death Benefits: How to Claim When Employers Disagree?

Rajkve
My father worked for an organization for the last two years. He shifted to another company last month. After five working days in the new company, he passed away.

Claiming PF Death Benefits

Now, what is the best possible way to claim his PF death benefits? His old employer is saying he is not eligible for the EDLI claim, even though he died just four days after his resignation. The current employer is stating he is not eligible for any benefits since he only completed five days with them.

Can someone please guide me on this matter?

Comment on EDLI Death Claim

It is the new employer's duty to pay the death claim benefit. The claim benefit would be in the range of Rs. 65,000 and Rs. 1 lakh. You should ask the employer to show proof that:
a) They have actually enrolled the employee in the EDLI policy.
b) The condition in the policy where it says the amount is not admissible.

What we heard from the employer is that he is not eligible for EDLI since he hasn't served a certain period in that company. My question is, how much service is required to be eligible for EDLI? I saw the joining documents of my dad, and he has signed the EPF documents.

I am not sure if there is a minimum service period required. You must ask the employer to show this as a stipulated condition. You could go to epfindia.com and navigate to the edli.htm page. All the rules are mentioned there. Unfortunately, I am not able to post a link.
