Is the Mathadi Act Relevant for Construction Sites Using Cranes for Heavy Loads?

shigan977
Can anyone tell me if the Mathadi Act is applicable to a construction site where the loading and unloading are entirely done mechanically by crane and hydra? The material is so heavy that it cannot be handled by men.

The Mathadi Act is applicable to scheduled employments wherein headload workers, who are unorganized, are involved. Therefore, in your case where mechanical power is used to load and unload the material, the Mathadi Act will not apply.

Thank you for the insight on the Mathadi Act application. I would like to ask you the following:

1. **Is the Minimum Wage Act Applicable to Mathadi Workers?**

2. If you have a toli registered on daily wages for the year and you do not need them later on daily wages but only for loading and unloading, can the contract be changed?

3. The Metal (excluding Iron & Steel) & Paper Board has arbitrarily raised wages by 40% (from Rs. 214 per day to Rs. 300 per day). They are also saying that the workers have to be paid for all 7 days a week. Is this justified? Can this arbitrary wage rise be challenged in court?

Thanking you in advance.

Is local transport unloading can be done without Mathadi? If a receiving 20-liter can of waterproofing material from Andheri to Sewri, is it compulsory to call the Mathadi union for unloading?
