Navigating Union Agreements: What Steps Are Essential for a Valid Contract?

Union Agreement Finalization Query

Dear all, I have a query. We are in the process of finalizing the agreement with the union for three years. This is the first time we are doing this. Now, what I want to know is if both parties agree to the terms and conditions of the agreement and it is signed:

1. Does this agreement have to be registered?
2. Do we have to involve a conciliation officer (Labour commissioner)?
3. If we do not involve him, will this agreement be considered sham and fake?
4. What if, after one year, workers ask for changes in the terms and conditions? Can management refuse to do so?

Thank you for your reply, but one question remains unanswered: if the agreement is settled between the union and the employer, do we have to register the same with the registrar's office? Is it mandatory?

If you read the Industrial Disputes Act, you will notice that the Act does not refer to the registration of settlements under this Act.

No, there is no need to get it registered at the registrar's office. However, you will need to send a copy of the settlement/agreement to the Conciliation Officer/Labour Commissioner of your area.
