ESIC Applicability - Esi Applicability

priyanka226
Dear All,
I would like to add one more aspect to this discussion.
If the staff is deployed through a labour contractor and is changed on frequent basis. The posting of staff is in the area where ESIC is not applicable but all staff has ESIC cards (issued from the main city-where ESIC is applicable) and get benefits in main city.
In such case, what shall the principal employer do. Whether they should pay ESIC or ask the labour contractor to get WC?
best regards,
Priyanka

Dear Sir,
If ESI Act is not applicable, The maternity Benefit Act and The Workmens' Compensation Act Will apply.

The esic act provides medical treatment facilities to the eligible employees. But the area which is not covered under esic can be covered uder employee compensation act. At the same time the employer can provide some other medical facilites like mediclaim insurance, personal accident insurance, group life insurance. In these insurance policy the premium should be paid by the employer and the employee will get the benefit from that policy.

Hi Vineeth,
The alternative option for ESI is THE WORKMEN COMPENSATION, especially when you don't have ESI applicability for some specific area.
