In a factory establishment, is the Bombay Shops and Establishment Act of 1948 applicable or not? Kindly advise.

If the establishment is in one premise, then no, that establishment will be covered under the Factory Act.

Applicability of the Bombay Shops and Establishment Act

The Bombay Shops and Establishment Act contains a specific provision that if the establishment is not a shop or commercial establishment and is connected with the manufacturing process, the Bombay Shops Act does not apply to it.

Applicability of the Bombay Shops & Establishment Act, 1948

If factories have less than 10 total manpower with the aid of power and less than 20 total manpower without the aid of power, then those factories are also covered under the Bombay Shops & Establishment Act, 1948.
