Dear Sir,
An Employee crosses Rs.1500o salary per month. He will come out of purview of the ESI Act.
If he crosses the salary in Middle of the Contribution, his contribution recovery will continue for the balance 3 or 4 months as the case may be . In this case, he will continure in ESI upto September because he has crossed Rs.15000 in April.
Whether CTC or in any case, if his salary crosses Rs.15000, he will be out of purview of the act,

Does ESI Ceiling Rs. 15000/- is Gross Salary or Earned Gross Salary ? On which basis we can decide employee is eligible for ESI.
if Employee is earning Monthly Gross Salary Rs. 16000/-
, but Earned Gross Salary Monthly is Rs. 14800/- now is he eligible for ESI.

Your employee has already exceed the limit of Gross amount of ESI which is 15000/month but still he want medical benefit so this is opportunity for you to proof your self and convincing him as per ESI Act.
Proof your self as a mature and experienced HR-Professional, do one thing ask management for Group Insurance Policy which will be beneficial for all employees who all are covering under Group Insurance Policy.
Your employees will surly appreciate you.
