Legal or Not? Understanding Double LOP Deductions in KPOs Under the Shops and Establishments Act

Though the recession is behind us, several cost-cutting measures are still in place. The KPO I'm working for deducts double LOP for every leave taken in excess of the monthly casual/sick leave quota. Is there a legal precedent for this under the Shops and Establishments Act?

When an employee has sick leave to their credit, the employer is not expected to deduct salary by treating the leave as Loss of Pay (LOP). Therefore, the question of deducting two times the average pay for every day of leave does not arise. Such exploitation typically occurs in the unorganized sector. To seek relief, you can present your case before the labor authorities. However, before taking that step, it is advisable to discuss the matter with the HR Manager and attempt to resolve it.
