Struggling with Duplicate EPF Account Numbers: How Can I Fix This HR Issue?

Hello seniors, please guide me on what I should write during NCP days. There is an issue with issuing member codes as my colleague has allocated the same account number (in form 5) of EPF to two persons since December 2011. Due to this problem, I am unable to submit the annual return of 10/11. Please help and guide me, as I am new to HR.

If your colleague has allotted the same number for two different employees, then one of them will have a wrong account number with respect to that employee, resulting in zero contributions for him. I believe you need to make a fresh contribution with the penalty charges as follows:

- Less than 2 months: 17%
- 2 months but less than 4 months: 22%
- 4 months but less than 6 months: 27%
- 6 months and above: 37%

You have the provision to recover the double contribution made to the same account number under sec. 32(1), which states the recovery of a member's share of contribution:

"Provided further that where no such deduction has been made on account of an accidental mistake or a clerical error, such deduction may, with the written consent of the Inspector, be made from the (Subsequent) wages."

There is no problem. Just fill out forms 5 and 10 again from December 2011 and send them to your regional office. Then proceed to submit the 2010/11 annual return. Everything will be okay. If you encounter any issues, please feel free to call me.

Understanding NCP and Resolving Account Number Issues

NCP means Non-Contribution Period. If any NCP days apply to the members, please specify the days for the respective members; otherwise, mention 0 (ZERO).

Regarding the same account number for two members, kindly submit the revised Form No. 5 for December 2011 with a covering letter. This will help resolve the issue, and then proceed to file the annual returns.

You should write a covering letter to the Assistant Commissioner of the PF Branch, stating that due to a clerical mistake, the same account number was allotted to two employees. Kindly request him to rectify this error by attesting the amended Form No. 5 and 6A. Additionally, make corrections in Form-9 of the PF Office.
