Need Help With PF Withdrawal: Can I Do It Without My Former Employer's Help?

Hi, I left my first company on 6th December 2010. At that time, I had filled out all the forms required for PF withdrawal. However, the forms got misplaced by the company's HR person. I waited for more than 6 months, but nothing happened. Then, I traveled abroad and could not proceed with the withdrawal process. Now, I need the money and want to withdraw my PF funds. How can I do it? Can I submit the forms without seeking help from my employer, or is it mandatory for the PF forms (FORM 10C and all) to be submitted by the employer?

I would like to inform you that you can't process your PF form without the help of your employer. You need the authorized signature and the company's stamp on the PF form as well as on Form 10C. Now, you need to get in touch with the HR person of that company.

Form 10C and 19 should be filled out and authorized by the previous employer. Along with that, the employer should enclose the following forms:

- Form 5
- Form 10
- Form 3A

Hi, you can get the forms approved by any gazetted officer. All forms are available on the EPF site or at any stationary shop.

It is not necessary to submit the PF withdrawal form through the employer. It can be submitted with approval by any gazetted officer, MLA, or MP. Form 19 and 10C are available at the EPF site or with any stationery shop.

It is mandatory to submit an affidavit stating non-membership for the past two months along with the withdrawal forms.

You should submit Form 10 and 19, duly signed and verified by your employer, along with Form 3A for your entire period of service in that company. Nowadays, it is also mandatory to provide your bank account details along with a canceled cheque for electronic payment to your account.

I recommend that after obtaining the signature, you personally submit your PF withdrawal form along with a covering letter to the EPF department. There is no need to submit Form 05 and 10; these are early formalities when you join or leave the company.

Hi Jai, thanks for your reply. I am planning to get a signature from a gazetted officer. In that case, where can I get Form 3A? Or do I need to get a sign on Form 3A? Can I download Form 3A from the EPF site?

Withdrawing PF Without Employer Contact

You can withdraw your PF amount without contacting the employer. It can be submitted with approval by any gazetted officer, and there is no need to submit an affidavit for non-membership. Since your previous employer was already informed to the PF organization via Form 10, whether you have resigned or left in the specified period, you are free to submit it to receive settlement.

My employer did not submit Form 10 to the PF organization. That is the problem. My employer has misplaced my forms.

I think you need to talk with the HR person at your company because, without their help, you can't easily access your PF. Alternatively, you could also speak with the relevant person at the PF office.

You cannot submit the form without the approval of a gazetted officer, MLA, or MP as they cannot confirm your Date of Joining (DOJ) and Last Working Day (LWD). In some cases, you also need Form 3-A, which your company will provide you.

PF is a benefit provided for your enjoyment. Just because you are uncomfortable with the management of your previous company, you are looking for alternatives, neglecting the easy way. Send them a formal email asking for the PF refund and clearly inquire about the forms and any other formalities required to be furnished in order to get your PF amount as soon as possible. Make it clear to them that you are claiming your right. After all, you are not asking for money from their personal pockets; it is your part of the money, and the company, as a legal entity, is involved, not the individuals holding positions in that company. So, empower yourself to deal with it in a pragmatic sense.

Alternative Signatories for PF Claim Forms

Generally, claim forms for PF should be signed by the last employer. If the employer refuses to sign, or in the case of the non-existence of the firm, you can submit the form by obtaining the signature of an MLA, MP, or any gazetted officer. The necessary details can be found in the claim forms themselves. Please take appropriate action accordingly.
