How Should I Proceed with Terminating an Employee Who Ignored a Charge Sheet?

Procedure for Employee Termination

Kindly let me know the action to be initiated further and the procedure to terminate:

A charge sheet was framed and sent to a worker who was absenting himself. He did not report for duty to date and also did not respond to the charge sheet. Please note that the worker was already warned many times and suspended for 3 days earlier.

Now, how to terminate this employee? Should we conduct a domestic enquiry or should I send a termination notice immediately?

Dear Saravanan, Please send him a termination letter by Registered Post with AD. Ask him to report for settlement for any balance. Close the file. Get rid of these types of employees.

Procedure for Handling Employee Termination

Prabhu's suggestion is okay but applicable only for trainees, not for confirmed employees as per the Principles of Natural Justice. If the employee is confirmed, you need to send the enquiry letter/Reminder letter 1 & 2 with previous communication details and his response details. In the second reminder, you should mention that this is final unless we have to consider it as ex-parte and terminate your service like that. This is the procedure we have to follow for that category of employee.

If the individual has not replied to the charge sheet, please conduct the domestic enquiry. For the principle of natural justice, you cannot take shortcuts. Please follow the complete process.

Even if you do not have any proof that the individual has received your communication, information about the enquiry should be published in the local newspaper.
