Clarification on ESI Challan Submission

I have a doubt regarding the ESI challan, which is submitted monthly to the SBI bank. The last date is the 21st of every month. However, I am unsure if this date refers to the cheque clearance in the ESI account or the date when the bank stamps the challan upon receiving it.

A senior official has informed me that ESI may penalize the employer if the cheque clearance is completed in the ESIC account after the 21st of every month.

Please provide me with any circular or official communication where this information is stated.

You are wrong because the last date for submitting the ESI challan is the 21st of each month, whether it is done through cheque or cash (cheque means clearing of the cheque).

Understanding ESI Challan Submission Dates

As we all know, the cheque submission date of the ESI Challan as per the ESI Act 1948 is the 21st day of the succeeding month of the wages paid month. Currently, we generate the ESI Challan online, and the ESIC receives information such as the Challan Creation date and Challan Amount Received Date (i.e., Cheque Realization/Clearing Date) in the information summary sheet from their side. ESIC is unable to access information about the Challan submission date at SBI bank through their online login.

When we submit the ESI Challan by cheque on the 21st day of the month to the bank as per the ESI Act, the bank takes 2-3 days to transfer the Challan amount to the ESIC Account. As ESIC does not receive the submission date information due to no requirement of hard copy half-yearly returns, through which ESIC verified the submission date earlier, ESIC may charge a penalty for payment delays based on the number of days.

Recommendations for Timely ESI Payments

Currently, ESIC suggests depositing the ESI Challan cheque 3-4 days before the due date, i.e., the 21st day of the month, so that ESIC receives the amount in their account before or on the due date. ESIC also provides an online payment option through the SBI Current Bank Account. Employers can transfer the amount online on the due date as the payment will be processed on the same day.
