It is mandatory to complete five years of service at present. In Tamil Nadu/Madras State, individuals who complete 4 years and 240 days in their 5th year will be eligible for gratuity as per the Madras High Court verdict.

Gurumuthy and Saurabh have clarified the point: it is 4.8, i.e., 4 years and 240 days, which will make the employee eligible for gratuity. The notice period is covered within this timeline.

Completion of 5 years of service is required for the payment of gratuity, and in each year, the number of working days should be 240.
