Navigating Job Termination: What Are My Friend's Rights and Compensation Options?

imok
One of my friends has been terminated from his job, and he doesn't want to try to convince his company not to terminate him. So, I just wanted to know:

1. Is he eligible for this month's salary, i.e., April 2012 (I think he is)?
2. Is he eligible for any other compensation?
3. What are his legal rights?

Kindly update me, as he believes that being in HR, I must know about this issue. However, being just a fresher, I have to learn so many things, and I have also never experienced such a situation in my company.

Entitlements upon Termination

He is entitled to a salary until the date of his actual relieving. He is also entitled to receive one month's salary as notice pay if he was not given notice one month prior. Compensation should be calculated at the rate of 15 days' pay for every completed year of service, provided he has been in service for at least one year.

However, nothing prevents a company from terminating an employee during his probation period or upon the expiry of the fixed term for which he was appointed.

Employment Status and Termination Notice

He is in the 8th month of the job and has an offer letter/application letter. So, I think he is not in the probation period. He was not given any notice before termination.

Is a terminated employee, whether a workman, supervisor, or manager, eligible for compensation? Is it in accordance with the Industrial Disputes Act?

Thank you.

He is entitled to:
- Salary up to the day he has worked in the organization.
- Notice or notice pay (if notice is not given by the employer) in lieu of notice in terms of his letter of appointment.
- Salary for the period of leave earned but not availed.

His coverage under the ID Act will be as per the opinion of Madhu.
