Understanding Professional Tax: Do You Pay If You're Present for 15 Days or Less?

Hi, this is Ramesh. I have a query regarding Professional Tax.

- If a person is present for 15 days or less, is he liable to pay professional tax?
- If a person is present for more than 15 days, is he liable for the same?

Please guide me in this matter at the earliest. I am waiting for your replies.

Irrespective of the number of days he is present, just check the gross salary he is drawing. Based on that, PT is deducted.

I have one case in my office: one of my colleagues was present for 14 days last month, and our HR deducted Professional Tax of Rs. 175. His gross salary is Rs. 11,000, and according to the salary working, his in-hand salary comes to approximately Rs. 6,500.

Professional Tax Deduction Query

Firstly, my question is, should his Professional Tax be deducted or not? If yes, then how much, because to my knowledge, it should be Rs. 200.

PT varies between states. In Karnataka, if the total gross is Rs. 11,000, the tax is Rs. 150. If the salary is Rs. 6,500, then no tax is applicable.

Thank you for reaching out. This seems to be a case from Maharashtra, and I would like to clarify this issue. If a person has newly joined the organization, for example, on the 17th of March, are they liable for P.T. deductions for that particular month or not?

Professional Tax Calculation for Maharashtra State

PT is calculated on earned gross salary and is applicable to all employees. Here is the calculation for Maharashtra State:

- Earned Gross:
- 0 - 5000: PT is 0 (No PT deducted)
- 5001 - 10000: PT would be 175 Rs.
- 10001 and Above: PT would be 200 Rs.

PT is not related to new or old employees; it is related to their total gross earnings for that month. If the earned gross salary varies, then PT would also vary.
