The overtime limit is specified under the Factories Act and the Shop Act, depending on the applicability.

Minimum Wages Act and Overtime Regulations

The appropriate government may fix minimum wages for any employment listed in the schedule to the Minimum Wages Act. It is not as though all the employments listed in the Schedule to the Minimum Wages Act are covered by the Factories Act, the Shops and Commercial Establishments Act, the Mines Act, the Plantation Labour Act, or the Motor Transport Workers Act, etc. In the schedule to the Act, there are several employments to which any of the laws relating to working conditions are not applicable.

One example will be employment in potteries included in the schedule by the Government of Bihar, employment in toddy tapping included in the schedule by the Government of Pondicherry, employment in sericulture, and employment in forestry included in the Schedule by the Government of Tamilnadu. In such cases, section 13 of the Minimum Wages Act gives power to the appropriate government to fix hours of work for a normal working day, and section 14 gives power to the appropriate government to fix the overtime rate also in respect of such employment. The normal hours of work for a day and the overtime rate will be indicated in the notification fixing the minimum wages.

With regards,
Regards
