Stuck in Notice Period Limbo: How to Handle Resignation Without Confirmation?

Dear All, I am working as Head of Department and have been with my company for 9 months but have not been confirmed by the company. I have now resigned, giving 20 days' notice, but my company is insisting that I serve the full 2 months' notice period. When I mentioned that I was not confirmed, they responded by saying that after 6 months, if you are not confirmed, then after 15 days, you are automatically confirmed. However, there is no mention of this in the appointment letter.

Please advise and if possible, share relevant documents.

Don't worry. Whatever the company says, you should follow your appointment letter. According to your appointment letter, you need to submit your resignation.

Firstly, go through your offer letter and appointment letter. What terms and conditions have they discussed with you? Only then can you claim the things.

If you have completed your probation period successfully and the company has not given any confirmation letter or extended the probation period, and you continue to do your work, it shows that you are a permanent employee of the company. The company provides all the benefits and facilities to you like a permanent employee. From the company's point of view, they are correct, and you have to serve the notice period. If you have completed your probation period successfully and the company has not given any confirmation letter or extended the probation period letter, and you continuously do your work, it shows that you are a permanent employee of that company. The company provides all the benefits and facilities to you like a permanent employee. From the company's point of view, they are correct, and you have to serve the notice period.

Please go through your company policy; it may help you a lot. Use your leaves completely until the end of your service period (i.e., notice period as per your service and appointment letter - read it twice/thrice).

Normally, confirmation of probation is communicated in writing unless otherwise specifically mentioned in the offer letter, i.e., upon completion of the probation period, you attain the status of a permanent employee. Therefore, please review the offer letter and the general terms and conditions attached to it. You can make a decision based on that.

I want to tell you one thing. As you said, you were not informed in your appointment letter that you would be permanent after successfully completing six months. I want to inform you that if you complete 240 days from your date of appointment, you will automatically be treated as a permanent employee. Some companies provide this in writing, while others may not. It totally depends on the company's policy.

Most companies keep their employees on probation for up to six months, but this period can be extended for an additional three months as per the company manual if the company finds your performance unsatisfactory. However, once you complete 240 days, you will be entitled to permanent status. In case of resignation, you will have to serve a one-month notice period.

Therefore, please review the offer letter and the general terms and conditions attached to it. Based on that, you can make a decision.

I suggest that you have your friend review your appointment letter as well. Whether the confirmation is accepted or rejected depends on your receiving it. Speak clearly to the top management and the Managing Director about your plans. He may not give you an appointment immediately, but try to communicate with him and resolve any issues promptly.

Normally, the probation period is 6 months from joining, but you have already completed it. If the management has not provided a confirmation letter, it will be deemed that you have been confirmed. It would be advisable to leave the company by giving notice pay as per the company policy, considering your future career prospects.
