Greetings of the day! Need your advice on the following case.
Summary:
An employee was working in a company where he was covered under EDLI. However, the company stopped EDLI contributions as they decided to take out a Group LIC policy for all employees and hence obtained an exemption from the EDLI authorities.
Now, an employee died during the period when EDLI contributions were stopped and before a new policy was taken. However, upon confirmation from the company, they show a letter they have written to the LIC, asking for the settlement of the claim.
Issues:
1. The company is not sharing the policy details with us, which would allow us to ascertain the terms and conditions of the policy and verify whether the deceased was covered or not. How can we resolve this?
2. Secondly, let us assume that the employee was not covered under the LIC. In that case, and otherwise also, is the company liable to pay compensation to the deceased's family? If yes or no, then why so?
I would request you to answer this with substantial case laws or any other statutory laws to help us build this case and file the same in the consumer court to get justice.
