How Can I Handle My Company Refusing to Honor My Resignation Notice Period?

I have resigned and given 20 days' notice to the company. However, the company wants me to continue my service for the full 3-month notice period as per the appointment letter. I am willing to pay the remaining amount for the notice period due to a family problem at my native place. Physically, I am present on duty, but mentally, I am preoccupied with matters at my native place.

The company is unwilling to release me after the initial 20 days, yet I am finding it challenging to fulfill my duties with full efficiency. I have already informed the president verbally about my situation, but he insists on not releasing me.

However, the new company has stated that my joining is subject to the submission of the acceptance of my resignation, which I am unable to provide as my existing company has not acknowledged my resignation with immediate effect.

Hi Prashant, you need to talk to your HR about this, and I am sure that there won't be any problem at all if you are ready to pay the penalty despite your notice period. But beware, this could create a rift in the relationship with your president.

If your line manager is not giving you the acknowledgment, you can use the following ways of communication:

- Register A/D
- Email
- Fax

Apart from this, you can explain in writing to the new organization that you have resigned from your present services and are not receiving acceptance from them. After all, your loyalty can improve this situation for you.

I agree with Mangesh Wakokdar. I think that before proceeding, you should speak to your HR to find a middle path that results in a win-win situation for both parties. Otherwise, you are only left with the options mentioned by Mangesh Wakokdar. This will be in the interest of both in the long run.

I am prepared to pay the notice pay penalty. Despite discussing this matter with the President and the HR person, both have refused to relieve me. They want me to sign a letter stating that I will serve a 3-month notice period from 12th March 2012, effectively relieving me on 11th June 2012.

Seeking Advice on Legal Actions

Please advise me on what actions the company may take if I do not return to the office from 1st April 2012. Also, what legal recourse do I have if the company issues a legal notice to me?

Please advise on the precautions I should take immediately.
