Dear Team,
Recently, one of our company employee met with an accident with Vehicle in working premises at sites, his one leg amputated and another leg is damaged, at this time, under which act employee can get maximum benefit i.e. Motor Tronsport Act, Employee's compensaiton act. and also confirm the methodolgoy of process.

If the employee is covered under ESI Act and then his claimed needs to be processed under ESI Act. If he is not covered under ESI Act, then the Employees' compensation Act is to be applicble. For this you need to verify whether your company is covered by the Schedule appended to the Act.
I do not think that Motor Transport Workers Act has any relevance in this context as does not seem to provide for compensation for accident cases.

First of all you have to send intimation to concerned insurance company, where you have taken WC policy. After that you have to submit all medical bills along with fitness certificate of injured employee and zerox copy of muster roll for reimbursement of medical expenditure as well as his wages for medical leave.

it sounds like a case of disability . Most of the time. Insurance companies don't tell you about the exception cases in which a person become disabled, then the insurance company or the employer has to continue paying him some disability allowance throughout his life.
Please don't hesitate in asking about it with various insurance companies and your friends because the condition which you describe, tells that the person won't be able to return to work so easily.
The insurance company might say that they don't cover this and that but then I would say consult the lawyers and they can get you a very heavy disability claim which can be helpful in taking care of the family and the medical expenses. The calculation happens. As for how much salary he was getting .

Dear Lingaraju,
Mr Alim Khan is right about the documents, Insurance surveyor will visit your site to check all the documents and will collect, Panchnama, mustrol copy before 3 months and after 3 months from the date of accident. Age proof and wage proof as these two things will decide the WC.
