Can I Get Form 16 If My Company Doesn't Include Me in TDS Calculations? Seeking Advice from HR Peers

Hi HR officers, kindly solve my query. I am working in a private company in Faridabad. My salary has been transferred to my salary bank account. The transferred amount is Rs. 22,000 per month. Am I able to get Form 16 if the company does not include me in TDS calculation? What are the common conditions to get a Form 16?

Form 16 is compulsory as per the conditions given by Mr. Amit. You have to show some kind of investment to take tax benefits.

If your taxable amount is zero after considering your investments, HRA, and medical expenses, your company might not issue Form 16. Instead, they could provide you with a Salary Certificate.

Form 16 Applicability

Form 16 is applicable to all, whether he or she is eligible to be a taxpayer or not. Employers must provide Form 16 to their employees upon request for issuing the form.

Dear Gunjan,

I completely agree with Amit Trada. Even if your salary is Rs. 22,000 * 12 = Rs. 264,000 per annum, not all components of the salary will be included in the tax computation. That is the reason your employer did not include you in the TDS calculation. However, you can still get Form 16 upon request.
