Struggling to Recruit Women for Night Shifts in India: What Are the Legal Requirements?

I am working as an HR Generalist in an MNC in Bangalore. We are planning to start adding women employees to the night shift, but I am not sure how many women employees to assign to the night shift according to the Labour Rules of India. I am finding it hard to recruit female employees for this shift. Can anyone help me with this issue as soon as possible?

A BPO is covered by the Shops and Establishments Act, which differs from state to state. Usually, the Shops Act imposes restrictions on working hours beyond a certain time at night. However, regarding the peculiar nature of requirements of I.T.E.S establishments, state governments might have permitted night shifts for women employees as well. I do not foresee any restrictions imposed by the Act on the number of women employees during a night shift, but the notification exempting the B.P.O establishments may have outlined conditions regarding the protection of women employees, their transport, and restrooms, etc.

You need to go through the Shops Act of your state.

You can employ any number of female employees for the night shift. It is your responsibility to safely pick up and drop them off at their residences every day.

Please refer to the attachments and the links provided here, which would provide some insight into your query. The Karnataka Shops & Establishments Act (Chapter VI) is the appropriate provision governing the matter. There has been an amendment easing the employment of women in night shifts under certain conditions. I will try to upload the information soon after I find it. However, there are no quotas for employing them.

Hi,
Under the Contract Labour Act (Karnataka Rules 1974), progressive and mandatory guidelines (on women's employment during night shifts) have been passed, which is applicable to all factories, establishments, IT and BT sectors.

I need some information and material on female employees working post 8 pm.

1. Is it necessary for all employers to file Form R, or is there a notification exempting IT/ITES and other organizations? If yes, please share the notification copy.

2. If anyone has the contractor labor notification of mandatory guidelines, please share.

3. Is it required to take a consent letter from female employees for working after 8 pm? Does anyone have a draft format? Please share.
