Dear seniors,

I was working with X company in April 2011, and I left that company. Now I want to withdraw my PF. The PF office is asking for Form 3A for 2011-12. I contacted the company's HRD, and they sent me a copy of Form 3A for 2010-11. However, they said they can't provide the form for 2011-12 because they haven't filed returns for this period yet. It will be filed in April. What should I do?

Yes, the company is right. They cannot give the Form 3A unless they file the returns. But there is no need for your 3A. You can fill out Form 19 and 10C with your previous company where they will detail your and the company's contributions for April alone. So, you don't have to wait until April-May for Form 3A. Just submit Form 19 and 10C, and they will take care of the rest.

Yes, Mr. Shenbagarajan is right. You only have to fill Form 19 and Form 10C and submit it to the PF office. Form 19 itself contains a Form 3A which shows your contribution. You can find that on the second page of Form 19.

Dear Rajeev,

The company is bound to issue you Form NO.3A irrespective of the submission of PF return. If they do not issue it, you can ask the PF authorities to issue a notice to the company.

What is this yaar? Management has to provide Form 3A along with your Form 10 and 19, both signed. It is their primary duty to submit it along with your form. There is no question of whether they file an annual return or not. There is no need to file an annual return for your single claim between the year. They have to prepare a separate Form 3A for you alone, or they have to declare in the form itself the contribution details for the running year. If they ignore this, please inform the PF Department Commissioner.

Dear Rajeev,

I agree with Mr. Ganesan because the company is bound to issue Form 3A along with 19 and 10c. This hardly makes any difference whether the company files the current year return or not. It is a contribution record. If they still say that they are unable to do the same, then please, please file a complaint with the PF Commissioner as suggested by Mr. Ganesan.
