Is It Fair to Switch an Employee from Full-Time to Part-Time? What About Their Benefits?

Hi, can somebody please tell me if it's okay to change an employee's status from full-time (exempt) to part-time (non-exempt)? What kind of agreement should we use? Can you send me the template?

There's not much work for this person, and she spends most of her time clipping her nails. How about the benefits once the status is changed?

Greetings,

You can change someone's employment status as long as you are not violating any labor laws or discrimination laws. You can only change an exempt to non-exempt or the other way if the job description changes or job duties change. The exempt to non-exempt status is in their job duties and not in a title. I would advise you to consult a labor attorney on this so you do not get yourself in trouble.

In India, before making such changes in service conditions, you have to give notice to the employee with intimation to the concerned authority of the government. This is required as per section 9A of the Industrial Disputes Act.
