Management Won't Give Payslips: How Can We Protect Our Rights Against Unlawful Deductions?

Please suggest how to protect our rights if management declines to provide payslips to know about unlawful deductions.

Every establishment will be covered under either the S&E Act, Factories Act, CLRA, etc. Therefore, for each act, the organization has to maintain the respective payslip format.

Your case will mainly involve proprietorship/partnership firms, as well as some family-owned private companies with less than 30-40 employees. If you have an HR department, all employees should approach HR. If not, ask them to speak with management. Alternatively, you can file a complaint with the Labor Inspector/DIL of your circle, and they will conduct a verification in your organization.

Unlawful Deductions and Lack of Response from Management

Management never listened and denied our requests. Every month, they unlawfully deducted money from our accounts. This unfair method of business was brought to the notice of the Labour Department; however, no one responded. Form-16 is the only base evidence for us. In the Form-16 issued by the management once a year, it shows several lakhs in excess and tax on that payment, even though such amounts were not paid to us.

Now, the management is informing us that they have not contributed to our EPF accounts either. Due to these unfair management acts, we are in deep trouble. After 10 years of service, we are losing our pension opportunity as well. Any suggestions you could provide in this regard would be greatly appreciated.
