Wage Demands for Pongal on a Non-Working Day: Should We Pay Our Loadmen?

sreejithssn@gmail.com
Dear all, Would you please help me out with an issue?

Wage Demand on Pongal

Our loadmen, numbering 8 on daily wages, are demanding wages for Pongal, which fell on a Sunday. For your information, they normally work Monday to Saturday only, as the depot does not function on Sunday. Can anyone please advise me in this regard? Is it necessary to pay them for that day? I couldn't find any information under the Shop & Establishment Act.

Contractual Issues with Loadmen

We have planned to put them under a contract, but they are refusing to accept it, creating problems, providing false information to the MLA, and also approaching the MLA for minor reasons.

They are not eligible for wages if they don't work on National Festival Holidays. Double wages are given only if they work on the NFH. It is better to try to eliminate one by one and bring in new people; otherwise, there will be a problem in the future for your organization.

Thank you.

I agree with Shenbagarajan, and what he said is exactly correct. Try to remove one by one because they are demanding unnecessary things; it is not good for your organization to continue with these kinds of employees.

For national and festival holidays, we can give add-on days if they fall on Sunday, i.e., an additional one day. It is better to avoid such confusions by clearly declaring the national and festival holidays themselves.

Thank you, Sir, for your kind information. I'm trying to eliminate these guys for the last year. In the beginning, there were 11, and now there are 8; the rest left on their own wishes only. Two among these eight are problematic, and I have no idea how to eliminate them. If approached, they take it negatively, and the matter may be taken to the MLA office with false information. The MLA office people call our in-charges and shout. I am very confused about how to clear the issue. They are very slow in work and seem to intend to create problems only.

Kindly advise me.

Sreejith
