The central govt has already implemented the 6 months maternity leaves .NOt sure about rest.

Hi All
Yes, there is amendment in the maternity act that is period of leave increased from 12 weeks to 6 months and bonus is also hiked upto 1000/= and a new paternity benefit is also under regulation for father of the child for the care of the women and child.

Dear Members,
According to me the answer to the above post has not been answered. Therefore I am making an attempt to resolve your queries. Section 8 of Maternity Benefit Act, 1961 after the amendment creates a liability on employer to pay Rs.1000 as a medical bonus, if no pre-natal confinement and post natal care is provided by employer free of charge. In the present context:-
Pre- natal means- period before pregnanacy.
Post natal means- after pregnancy
Confinement - means labour resulting in the issue of a living child or labour after 26 weeks of pregnancy resulting in the issue of a child whether dead or alive.(Refer Section 2 (3) of ESI Act,1948)
So,if employer has paid the such charges to such women employee then such employer is exempted under Section 8 of Maternity Benefit Act or vice-versa.

I am preparing for my third delivery in november. when i asked my employers for the maternity leave with pay, they say they have maternity leave with pay is only for the first two kids. when i referred the maternity leave benefits, i couldn't find any number limitations on delivery. can anyone help me to find out whether we have a number limitations on maternity leave with pay?

Hello Everyone,
I need help in understanding a doubt of mine wrt Maternity Benefit Amendment Act 2016.
Suppose a woman has applied for Maternity Leave as per old rules (twelve weeks leaves) and while she was on leave, this amendments are notified by Government and new rule of twenty six weeks becomes applicable.
Under such scenario, can woman (already on leave of 12 weeks per previous act before amendment) extend her leaves (legally) to 26 weeks per new amendments?
I am sure many people will have this question.
Any help/guidance on this will be humbly appreciated.

Dear friends,
Yes, these doubts would emerge one after the other till a clarity is available. Let us await proper gazette notification which likely to be issued once the President's accent is given for the bill now passed by the parliament. Till then it is not proper to answer to such queries with hypothetical view point. Hope the notification would address these queries.

To clarify further on Anuradha's query -
natal ( a Latin word) meaning 'of or relating to birth'
Pre- natal means "before birth"
Post natal means " after birth"
These terms are available in any dictionary which the queriest should make use of as frequently as possible as referring and gaining knowledge should be a habit of every day life.
Maternity leave IS NOT applicable "before pregnancy" but only after (during the)"pregnancy" in a female employee is confirmed and after the birth of a child or termination or abortion or 'still born' as the case may be. Refer the Act for further info on this.
