Struggling to Get My Pension Settlement: How Can I Resolve This with My Former Employer?

My name is Shiva Shankar, and I resigned from my previous organization in August 2010. I received my Full and Final settlement in September 2010, but I have not yet received my pension settlement/scheme certificate from my previous employer.

I submitted Form 10C at the time of relieving from my previous organization. When I inquire with my previous employer about my pension, they inform me that the payment has been forwarded to RPFC, Bandra, Mumbai.

I have contacted RPFC, Mumbai, but I have not received a satisfactory response from them.

I kindly request assistance from senior members to help resolve this situation.

Dear Shiv, you have not mentioned the period of your service. You will receive the pension scheme certificate only if your service was more than 9 years and 6 months. If it is less, the accumulated amount would have been credited to your bank account.

Furthermore, the scheme certificate is being sent by RPAD. The postman might leave the intimation of RPAD at your house, and if it is not claimed within a week, the mail will be returned to the PF office. Therefore, please check the details mentioned above and then contact the PF office in your area.

Let me correct that a Scheme Certificate can be obtained even if your service is less than 10 years (i.e., the pensionable service of 9 years and 6 months) since it is a certificate that keeps the past service alive.

Please check whether you had opted for the Scheme Certificate in Form 10C when you submitted the same. If you had less than 10 years (or at least 9.5 years) of service, you would get the withdrawal benefit only if you had opted "NO" against the column/question "Are you willing to accept the Scheme Certificate in lieu of the withdrawal benefit" in Form 10C. If you had marked "YES" against it, you will get the Scheme Certificate, and the issuance of the certificate is done by the EPFO, in which the past employer's role is limited to the submission of the said form only.

Therefore, you may write to the EPFO stating that you had applied for the Scheme Certificate in Sept/Oct 2010 and the same has not been given to you. You have joined another establishment and have to surrender the certificate to the present establishment forthwith, and therefore steps should be taken to send the certificate at the earliest. If you do not get a reply, submit the grievance before the authorities by writing the same to the Central Provident Fund Commissioner. Action will follow within two or three days.

Thank you for your valuable reply. My service in the past organization was 2.5 years. I have not applied for a Scheme certificate; I have only applied for withdrawal. However, I have not yet received the amount.

Kindly assist me in identifying whom I need to contact further.

The status of the application can be viewed online by visiting the website of EPFO. However, it is advisable to contact the PF Office in person and collect the status.

As you have submitted Form 10C, you will receive the Pension Scheme Certificate at your address by registered post from the P.F. authorities. It may take some time, but there is no need to worry. Please wait for 6 months, and if you have not received the certificate by then, kindly submit a Pension Transfer request using Form-13. This will ensure that your pension amount is transferred and merged into your present account. It is always advisable to transfer the pension to your current P.F. account instead of directly applying for a pension certificate using Form 10C.

I recently withdrew my amount but mistakenly marked the withdrawal option instead of the scheme certificate. My service period is 1.5 years. How can I claim the pension amount?

Hi Rana, once your EPS settlement is done, you cannot obtain the pension certificate. You have to choose the option at the time of your PF withdrawal so that your old PF account will be closed after the full settlement.

Dear Shiva,

You can ask your employer for the acknowledgment slip that can be issued at the time of submission. Also, inquire with your employer about the rejection letter in case the submission is rejected. They can find the rejection letter which will be sent to them. Ask them to check the old rejection documents.

I am R.V. Kanse. I resigned from a private company on 22/10/2014. The company submitted the 10-C form to the EPF office in Bandra on 03/07/2015. To date, I have not received the scheme certificate. Whom to contact and what is the procedure to follow? I have completed 24 years of service. My date of birth is 8th January 1968, date of joining ---- 15/11/1990, and date of leaving ---- 22nd October 2014.

How can a government servant have a higher pension than the maximum prescribed figure of Rs 7500? Can anyone explain, kindly? Thank you.
