How Can I Claim My Dues and PF Without a Resignation Acknowledgment from My Employer?

I worked at a Pvt. Ltd. company from 10.06.2001 to 14.12.2011 in Kolkata. On 14.11.2011, I submitted my resignation letter through the proper channel to my M.D. with a 30-day notice period. Unfortunately, I have not received a copy of the resignation letter until now. After the 30-day notice period, i.e., on 13.12.2011, I stopped going to the office. However, I still have not received a copy of my resignation acknowledgment. In this situation, what should I do? If they have not acknowledged my resignation, how can I claim my full and final dues and withdraw my P.F.? Please advise me on the procedure.

Do you have an email or any other communication from your supervisor regarding your resignation? If not, then this could indeed be a problem.

Steps to Address Resignation Issues

First, follow up with your immediate supervisor and HR. If that does not yield results, send a letter by registered post stating that you had previously submitted your resignation. If possible, attach a copy of your original resignation letter. Then, request for your dues to be settled. There may be some disagreement with HR and the company, so be prepared for that.

If they have ceased paying your salary without any legal notice regarding your status, then it is evident that they are aware of your resignation.

When sending the letter by Registered Post, please ensure to clearly state all the facts.

Thank you for replying to my post. However, I sent an email on 04.01.2012 to my HR regarding the non-receipt of an acceptance copy of my resignation, which I had submitted for your reference (see below in brackets). Now, please advise me on the future procedures.

(As per my resignation letter submitted to your end dated 14.11.2011, I provided a notice period of 30 days from the date of my resignation letter. However, I have yet to receive any confirmation accepting my resignation from your end. I kindly request once again for the release of my gratuity and other outstanding dues by 14.01.2012.)

Have you talked to your HR and your manager regarding your settlement? I hope you informed the concerned manager on your last day that you would not be returning from the following day since your notice period has ended.

Hi Saswata, I only want to know that if I do not receive the accepted copy of my resignation letter from my employer, what kind of problems might I face in the future?

If you receive your money (Full and Final Settlement) and obtain an experience letter, or at least a relieving letter, then you should have no issues. A future employer you join may ask you for your relieving letter.

Since you worked for so long, you should be receiving your gratuity. Also, make sure to get your PF form signed for transfer to the new company (assuming you have PF).
