Understanding Leave Policies: Is Sunday Counted as a Weekly Off for CL & EL?

Would like to know something about leaves. In the case of CL & EL, is Sunday counted as a weekly off, or does leave have to be adjusted against that? For example, if an employee applies for a CL on Saturday and Monday, is Sunday considered a weekly off, or does he have to put in a CL on Sunday as well?

Ms. Vidya, firstly, you should clarify the leave details. In the case of general or shift employees, it depends, but normally Sunday is considered a weekly off. CL and EL can't be clubbed.

Dear Vidya,

Whether to count Sunday as leave depends on the policy of the company. Some companies consider the weekly off falling in between the leaves applied for as leave, while others do not. Moreover, as far as CL is concerned, the employee gets it as soon as he joins the organization. It lapses at the end of the year if not availed, while EL is earned for every 20 days worked, accumulated, and can be encashed later at the time of retirement/leaving.

EL is earned every 20 working days, and CL will be transferred to the account as soon as the employee joins the organization. CL will lapse at the end of the calendar year, and EL will be transferred in the next calendar year.

One can earn Earned Leave (EL) every 20 working days, and Casual Leave (CL) will be transferred to an employee's account as soon as they join the organization.

Understanding CL and EL Policies

Legally, there is a concept of CL. It is company policy to provide CL, and whether Sundays and holidays falling in between CL are considered as CL or as Sunday/holiday depends on the wording in the policy.

For EL, crediting is subject to the Factories Act/Shops and Establishment Act, as applicable. However, the counting of consumption again depends on the company's policy, as stated above.

If there is no defined policy, refer to the precedence that has been followed in the organization. If this is the first case, then it is the right time to frame the policy and put it to use.
