Resignation Notice Period Dilemma
I have resigned from my job, giving a notice period of 1 month. In the appointment letter, the company has mentioned a notice period of 3 months or 3 months' salary in lieu of notice period. Furthermore, the company has stated that it is at the discretion of the company to accept a shorter notice period.
However, the company is now adamant that it will not release me before the completion of 3 months. My new company is requesting a relieving letter from my previous company. The previous company is aware of my new company, and the new company's HR is concerned that the previous company may issue a letter regarding this matter.
I submitted my resignation in hard copy. I have completed 1 month of the notice period and am willing to pay for 2 months for the shortened notice period. I have delegated all my responsibilities to my successor who was appointed to fill my position.
Question on Employment Contract and Notice Period
My question is, when an employee does not want to work, a company cannot force him/her to work for a full 3-month notice period; the employment contract should terminate based on this issue.
I am still serving the notice period of 1 month, which is due to expire in 2 days, and the management has approved my resignation with the 3-month notice period. The new company requires me to join within a maximum of 1 month with a relieving letter. What is the maximum damage my present company can inflict on me and my new company?
