corrected_content: Can anybody help me regarding salary calculation based on 26 days per month? If someone is on continuous leave for 15 days, will the off days also count as leave or not?
Rana Imran228
The salary will be calculated as if someone is continuously absent from the 1st to the 15th of the month. If there is an absence before and after an off day, then the off day will be deducted; otherwise, it will not be deducted.

You have not mentioned whether you have your own leave policy. If not, you are to be governed by the statutory provisions of the Acts applicable to your establishment. There are two main Acts that provide for annual/earned leave. One is the Factories Act, 1948, and the other is the Shops and Establishments Act of your state. The issue is to be approached as under.

1) If your establishment indulges in the manufacturing process and is covered by the Factories Act (employing ten with power or twenty without power), you need to follow the Factories Act. If so, sec. 79 of the Act excludes holidays or off days falling during the leave period.

2) If your establishment is covered by the Shops Act, then you have to refer to the relevant provision in your state Act as it may differ from state to state. For example, the Bombay Shops and Establishments Act include weekly offs falling during the leave period of the employee as part of the leave.

Hope this will clarify your doubt.

In this case, you will calculate the salary as given below: total salary divided by 26 and multiplied by 24.

If the month has 31 days and there are 4 off days, it means there are 27 working days in the month. If someone is present only one day, how will this be calculated in a 26-day calculation environment?

Understanding Salary Calculation Based on Month Days

If the salary calculation is based on month days where holidays and off days are paid, kindly help me understand whether in the following scenario the sandwich will be marked in the system or not. This pertains to whether these days are paid or not:

- Absent
- Off day
- Holiday
- Holiday
- Holiday
- CPL
- C/L
- Absent

In this case, will these off/holiday days be paid in the month or remain unpaid and declared as a sandwich?
