Earned Leave Calculation Clarification

Please let me know, in the case of earned leave calculation, do we have to calculate working days / 20? Is this working days count inclusive of PL, CL, SL, paid holidays, maternity leave (3 months), with the exception of weekends off? Kindly clarify.

Impact of Less Than 240 Working Days

What happens if the total working days in a year are less than 240 days? Will all PL lapse? For example, if there are 200 days, 210/20 = 10 PL will lapse? Will the employee not be entitled to any PL for that year? Please explain.

Is this a loss for that employee?

You have to calculate physical presence only for Earned Leave (EL) calculation. If she has not worked more than 240 days in a calendar year, you can consider the following for eligibility, but you have to calculate the EL only for working days:

1. Any days laid off.
2. Maternity leave availed.
3. Leave earned in the year prior to that in which the leave is enjoyed.

These shall be deemed to be days on which the worker has worked in a factory for the purpose of computation of the period of 240 days or more, but he/she shall not earn leave for these days (Factories Act 1948 - sec. 79).

You can add the maternity days to calculate the earned leave eligibility. However, you should allocate one day of leave for every 20 working days, not for the total maternity leave period.
