Can Ex-Employees Withdraw PF if Our Company Hasn't Submitted Papers Yet?

My company has its registration number and PF number. It's a 2-year-old company. We have hired consultants who are submitting and taking care of PF cheques/challans every month. We have not yet submitted papers to the PF office.

Will the PF amount be withdrawn by ex-employees? Late fees will have to be paid to the PF office, and if not paid, can the employees receive their PF amount?

As you mentioned, your company has been registered under PF and compliance, with your hired consultant overseeing the entire PF process. Why are you not seeking compliance under the act? Non-compliance could result in penalties or other consequences as required by the rules. Former employees can withdraw the amount deposited by the company by submitting an application to the PF department. If any irregularities are found, the company will be held responsible for the defaults.

We are in the process as consultants, guided unless the penalty amount pending with the PF Office, our number won't be displayed on the PF site. So, that's why I wonder if the penalty is not paid, then is it possible that the employees' contribution amount of PF may not be withdrawn?

Also, is it possible that we can nominate two authorized signatories for PF documents?

If you don't mind, first call your consultant and ensure that all amounts due to your employee have been paid to the PF office on time. In the future, do not depend on the consultant; make sure he is reporting promptly.

Inquiry and Penalty Explanation

After conducting an inquiry, please explain why the penalty was imposed for the detected irregularity and why it was not reported on time. The issue of employee withdrawal should not be affected. Apply to the PF Department for withdrawal. If you encounter any difficulties, please let us know.

Thanks a lot for the guidance, but the problem is from our side. Our earlier HR personnel did not take all this work seriously. Now, all this has been handed to me, and I want to clear it as soon as possible.
