Seeking Common Leave Policies: What Do Most Companies Offer?

Dear All, please provide me with a leave policy that is generally used in companies.

Leave Policy for Trainee Staff

Can anyone tell me about the leave policy for trainee staff? In my previous company, there were 7 CL (Casual Leave) and 7 SL (Sick Leave) on a prorated basis, but the current company policy states that a trainee is not eligible for any leave during the training period. Please advise as per our Factory Act.

Trainee Definition in the Factory Act

Based on my knowledge, there is a definition for a trainee in the Factory Act, i.e., a trainee is also a hired candidate of the company; hence, a trainee is also eligible for all benefits like any other staff member.

I work for a non-banking financial company and would like to know about the components to be considered for leave encashment calculation. Also, what is the maximum limit of leaves up to which an employee can accumulate their leaves?

There are no specific protocols for trainees; it depends on the company's policies. Actually, as per management, trainees should be given 1 CL and 1 SL during the training period. After the completion of the probation/training period, they become eligible for earning leaves. Alternatively, upon completion of 1 year, they shall be eligible for a minimum of 15 EL to 30 EL, depending on how the company handles it.

The completion of the year follows this timeline: if X joins on 1st January, the protocols include 3 months of training, and the joining date would be 1st April.

My query is regarding the leaves for trainees. I also utilized the research box for the leave policy but could not come to a solution. As we know, as per the Apprentice Act, we provide 12 CL and 15 SL on a prorate basis for the year. Then why are trainees not eligible for any leave? In my view, trainees should be eligible for CL and SL like other staff members.

Please advise as per the factory acts instead of any company policy.

Leave Policy for Trainees

Is your company registered under the Trade Apprentice Act? In such a case, they can decline to give leaves to the trainees. However, they need to adhere to the stipulations as mentioned in the Act.

Otherwise, it is necessary to give Sick Leave to the trainees too, not exceeding 1 day per month.

The component considered for leave encashment will be the gross salary, inclusive of all allowances. Encashment of 45 leaves can be done; exceeding that will be shifted to the next session.

As per the act, leave encashment is calculated on the basic salary. The leave that can be encashed is Privilege Leave. If staff require money and they want to encash the leave, then we can proceed with the encashment. Additionally, in many companies, leave can accumulate up to 240 days, and if it lapses, it needs to be encashed.

The calculation is based on the latest basic salary. For example, if I want to encash 10 PL and my basic salary is Rs. 10,000, then the amount will be 10 * 10,000 / 30 = Rs. 3333.

I have posted several times regarding the leave policy. This is a very tricky question, and the leave policy cannot be framed for all because it depends on many things. Whether your company is covered under the Factories Act or under the Shop and Establishment Act, all states in India have their Shop and Establishment Act, and leave provisions are different in all states. Therefore, there cannot be a thumb rule for the leave policy.

Leave Policy for Factories

However, in the case of factories, earned leaves are given as per the Factories Act, i.e., one leave for every 20 days of working. In addition to this, sick leaves and casual leaves are given as per the certified standing orders, which is generally 7 each.

As I have seen, even contract workers are eligible for leave every 20 days. Since you are a trainee, you should also get at least the same.
