Dear seniors,
We had hired an employee around 6 months back on 6 months probation which she is about to complete very soon.Now, we just came to know she is already looking for a change.Can we inform her that performance has been found unsatisfactory and not confirm her ?

How you found that performance is not satisfactory. What efforts you / your organization has to taken to improve the same?
Why the employee is looking for change?
Does your organization having any issue with the prabationer employee ?

but we cannot hav employes taking the company for granted, right ?

You cannot take any action unless it is subject to the clauses mentioned in the appointment letter.
Employee who is on probation period can quit the company within a day, notice period is not applicable.

Presume a situation where you are working satisfactorily but you do have dispute / concern with company then if you raised the dispute / concern to higher authority/ authorities then suppose nobody interested to pay attenation to your request then in that case you started looking for job change?
So based on this company terminates you?
It is justifiable on the front of company?

Then how can you restrict for not giving his confirmation letter. Discuss with the employee for its future planning & convince her opportunity in your company. U know retention of employee is more challenging for us in these days.

Yes..I agree....but if this particular person came from a well known company and my company is not a reputed..so obviously she would not stick around for long.....plus my management will never tolerate somebody looking out for a change so soon

I think you have some assumption about this particular employee of yours . If you have known through the CONFIRMED source that she has got an offer and is abt to leave after 6 months -- then better speak with her and try to find out her future plan with your organisation or otherwise.
But as far as appointment's clause is concerned -- I don't think you can stop her confirmation as it may become a legal issue. Moreover it may also affect the morale of other employees.

My Dear Friend,
Just because one is seeking a change does not make the person a non-performer.
Please be a little more pro-active and find out why she planning to leave. maybe you can salvage the situation and take steps to retain her.
By not confirming her what would the objective you would achieve.
