Bonus - Is Ex Gratia Mandatory Or We Can Avoid Ex Gratia?

Dear All,
I am sundar, I am worked for puplic limited co. for past 2.5 years recently i will resigned my job in apr-2011. I will ask hr for bonus 2010-11. That person told him resigned people they will not give bonus and i will worked for that previous finacial year-2010-11. My Basic Salary is Rs.4000/- and Gross Salary is 13500/-.So, Kindly help me anyone how to can get my bonus

Greetings for the day,
Tell that HR Personnel that go through the bonus act then only he is able to comment on the same.The act clearly states that bonus is payable to them also who were resigned/terminated during that currency period, you are eligible for bonus of 2011-12 since you have resigned on apr.-2011.If they unable to pay the same you may contact to the bonus inspector of the concern area of that labour dept.

If an employer is paying exgratia in lieu of bonus to existing employees in a particular grade,whether same is compulsory to be
disbursed to ex-employees for the period employed with company.

Dear Anil,
If the concerned left employee coming under the Bonus coverage limit(i.e. salary less than or equal to Rs 21,000) & Bonus accounting Period then left employee also eligible for bonus.
If More than 21,000/- will be considered as Exgratia then any (Existing or left employee) has no right legally for claim. It's purely depend upon the Management decision to pay or not to pay.
