Could you help me regarding contract labour Law. what document to be required n how to maintain it.

Dear Bandana,

Muster Roll, Wages Register, Deduction Register and Overtime Register by Contractor must be Maintain:

• Every contractor shall

• Maintain Muster Roll and a Register of Wages in Form XVI and Form XVII respectively when combined.

• Register or wage-cum-Muster Roll in Form XVII where the wage period is a fortnight or less.

• Maintain a Register of Deductions for damage or loss, Register or Fines and Register of Avances in Form XX, from XXI and Form XXII respectively.

• Maintain a Register of Overtime in Form XXIII.

• To issue wage slips in Form XIX, to the workmen at least a day prior to the disbursement of wages.

• Obtain the signature or thumb impression of the worker concerned against the entries relating to him on the Register of wages or Muster Roll-Cum-Wages Register.

• When covered by Payment of Wages Act, register and records to be maintained under the rules

• Muster Roll, Register of wages, Register of Deductions, Register of Overtime, Register of Fines, Register of Advances, Wage slip. Rule 79

• To display an abstract of the act and Rules in English and Hindi and in the language spoken by the Majority of workers in such forms as may be approved by appropriate authority Rule 80

• To display notices showing rates of wages, hours of work, wage period, dates of payment, names and addresses of the inspector and to send copy to the inspector and any change forwithwith Rule 81

Vineet has rightly elaborated the documentation required. I just wish to add that there should be a proper Contract agreement with the service provider with elaborate clauses and indemnity, as also the contractor should have a valid licence from the authority ESI, PF code no if necessary and also the employer should have registered with the local authority.

Hi,
If party is asking for monthly comlience certificate and attendance of staff who is deputed at their sites then? what is the procedure for them? party said that they will release balance payment after receiving of compliance documents. what procedure we can adopt for this??

ok, There is any other thing like salary slip etc. Actually they were asking for salary slip also.

but they are asking for salary sheet. after receiving of all documnet they will release our balance payment. plz guide me wht could we do in this situation?

Hi Bandana,
The list of documents suggested by Mr. Vineet is absolutely correct,You are requested to follow those compliances and your problems will be resolved. And one more important thing, that no employer can deny legal salary of any employee.Even if the emplyees are under contract the salary is to be made to him.The Non compliance can only lead to cutailment of service charges in such cases.

They will ask but make sure, if there were any other exec before you' have been given such documents to them or not. If they already provided such documents to them then give them Wages Register xerox copy where the workers have signed while they recived their payment.

Kindly read contractor labour act before taking any action,
First point-First understand "why are they asking about compliance and documents."
all documents are required like from contractor registration no(if more than 20 workers/12 months) to salary slip(due to salary slip it is must for all employee/ workers)
again I am telling you first read contractor labour act (including minimum wages).

I think they are asking for wage slip to see the components of your salary slip & cross check with PF challan and after that they might ask for Form 3A and 6A under PF....It will better for you to read & understand your contract agreement..what are clauses & legal requirements and also the components and benefits under the purview of wage in your contract agreement with the party...
