Leave Policy As Per Karnataka Labour Law For A.Y. 2012-2013

Hi All,

Can someone please tell me the types of leave and the number of days that employees are eligible to avail in the State of Karnataka for A.Y. 2012-2013? I would also like to know about the types of leave that can be carried forward/encashed or that lapse if not availed.

Regards.

a. An employee will be eligible for Earned Leave only if the employee had worked for at least 240 days in the calendar year or in the case of a new employee who has joined after 1st January of the said calendar year, if he has worked for at least 2/3rd of the remaining calendar year.

b. While availing Earned Leave, intervening weekly offs and paid holidays are excluded.

Maternity Leave:

a. Every female employee shall be entitled to Maternity leave for a period not exceeding 12 weeks (6 weeks before delivery and 6 weeks after delivery) after she has worked for a period of not less than 80 days in the 12 months immediately preceding the date of her expected delivery.

b. All the holidays occurring during the leave shall be counted for the purpose of computation of 12 weeks.

c. Female employees covered under the provisions of the ESI Act will be eligible for maternity benefits/leave as per the provisions of the ESI Act.

Hi,

I am working in an Ahmedabad-based IT company. We have 30 employees in our company. We have the 1st and 3rd Saturday off, and we provide two paid leaves in a month, which will be reimbursed by the end of March if they are in the employee's account balance. Leave reimbursement is based on CTC. Currently, there is no finalized policy for PL, SL, CL.

We are considering changing our office working days to provide all Saturdays and Sundays off. In that case, I would like to receive some suggestions on how we can design a leave structure and policy that aligns with providing every Saturday and Sunday as holidays. This new structure should be beneficial for both employees and the employer.

Here it says PL shall be lapsed each year, as per my knowledge, PL cannot be lapsed for 3 years. We may request employees to use it or we may encash it.
