PF Form 11 [Thread 371887]

Hello Friends,
One of our trainee employee has completed his training and now want to become a permanent employee. He doesn't want PF to be deducted. His basic pay would be below Rs. 6500/-.
In this case, is keeping a Form-11 filled and signed by the employee enough to keep the employee out of PF? Please advise.

NO. if the employee is getting Rs.6500 below salary, he has to come under PF. He needs to be deducted PF. No other way

In our case the employee is totally fresh and this is his first employment. Is it legal to keep him away from PF deduction? If possible what is the formality?

Mr Sanjeev, the same answer of your question you can find there..i have mentioned all the possible things..As the EPF has never deducted for this employee, can ask for this by declaration under applicable rule..

I would like to ask that if a company has mentioned wrong name in PF account & given wrong PF account No to employee( when trying to see online status then it shows wrong). Employee has left the job and company is not taking necessary action to process his PF withdrawal from last three years than what one can do? Company is based in Bangalore & employee was working in Ahmedabad.

hmm in that case you need to go to your local EPF commissioner along with the required doc that can proof your EPF number provided by Employer..they will take necessary action against employer ....but before that you would suggest you to speak to your Head of HR with employer and try to get the solution of your problem. ..

Ok, well i wud suggest you to make a request to your local EPF Commissioner or can visit to them personally in this regard as i suggested you above. Have you ever tried to visit your employer personally if not, i wud suggest you to do it once.

Dear Sanjeev,
You have mentioned that the employee is trainee and his salary is below Rs.6500/-, why your concern was not deducted EPF on the same earlier, but he is job continuesly he should be eligible for epf deduction as far as from 11 is concern it is necessary for those who are exempted from epf and the salary cealing should be above Rs.6500/- below than that epf deduction is must.
