Gratuity - Gratuity Basic [Thread 370469]

Hi
I have resigned from my job and has spent five years & 2 months in that company.
Am i eligible for the gratuity?
Also i have filled the form I of gratuity and submitted to the company one month ago. they are saying that we will provide gratuity on december. Would this be valid or they trying to delay?
What should i do here?
Also how the gratuity be calculated i.e based on last basic drawn or basic salary of individual year?
Please help.

Yes, you are entitled for Gratuity.
You can ask the company HR i some papers are to be filled or they will just pay after a period of time.

Last Basic drawn and you will get the Gratuity.
May be the HR dept wants to process your Gratuity with LIC and that too , it will not take time upto December.
Follow up with your HR dept

This would be calculated as. Last drawn basic salary+DA (if any as per annexure)*15 days*No of years served/26.

U have completed your 5.2 yrs of Service ,
Last month basic salary*15/26*62(12*5=60) ie Five yrs of serivce ,
you can contact your HR people Regarding this

Please mention your number of years of service also to calculate.
you can do it yourself as well. Just add no of year in place of X below.
34550*15*X/26= answer. The maximum gratuity amount is limited to an amount of Rs 3.5 lac.

AS PER GRA ACT IS IT 01/01/2006.PL CLARIFY.
MY BANK GAVE 3.50LAC ON MY RETIREMENT
1.23LACS ON05/10/2010
SO WHAT IS THE MAX LIMIT FOR GRATUIYT RETD ON DEC 2008.

Hi,
Max Gratuity Limit for the person who retires/resigns before 2010 is 3.5 lac. The ammendment made only after 2010 and increased the limit to 10 lac.
