Am I Eligible for Gratuity After Resigning? Seeking Advice on Delays and Calculations

Hi, I have resigned from my job and have spent five years and two months in that company. Am I eligible for the gratuity? Also, I have filled out Form I of gratuity and submitted it to the company one month ago. They are saying that they will provide the gratuity in December. Would this be valid, or are they trying to delay? What should I do here? Also, how is the gratuity calculated, i.e., based on the last basic salary drawn or the basic salary of the individual year? Please help.

Yes, you are entitled to gratuity. You can ask the company HR if some papers need to be filled out or if they will just pay after a period of time.

Gratuity Processing and Eligibility

Your gratuity will be based on the last basic salary drawn. It seems the HR department might be processing your gratuity with LIC, which should not take until December. I recommend following up with your HR department for more clarity on the timeline.

This would be calculated as: Last drawn basic salary + DA (if any as per annexure) * 15 days * number of years served / 26.

You are eligible to withdraw your gratuity. You have completed 5.2 years of service. Last month, your basic salary was calculated as follows: basic salary * 15/26 * 62 (12 * 5 = 60), representing five years of service. You can contact your HR department regarding this matter.

Gratuity Calculation

Please mention your number of years of service also to calculate. You can do it yourself as well. Just add the number of years in place of X below:

34550 * 15 * X / 26 = answer. The maximum gratuity amount is limited to an amount of Rs 3.5 lakh.

The maximum gratuity limit for a person who retires or resigns before 2010 is ₹3.5 lakh. The amendment was made only after 2010, increasing the limit to ₹10 lakh.

I joined the organization on 9th July 2007, and my last date is 10th April 2012, which will be 4 years and 270 days, including weekends. Will I be eligible for the gratuity?

Please refer to my earlier post. You are well entitled to gratuity based on the following calculation: basic salary + DA (if any as per annexure) * 15 days * Number of years served / 26.

Therefore, please approach the HR department to take the necessary steps.
