Hi, I have been working as an Assistant Manager IT in a construction and malls leasing firm for the last 16 months. I was initially appointed as an Engineer and then promoted to Assistant Manager, but I have not yet received my confirmation. Now, after 16 months, my company's HR is asking me to resign as they are eliminating the Assistant Manager position. If I do not resign, they are threatening to terminate me. What should I do? Am I legally a confirmed employee? I have neither signed nor received any letter stating that my probation was extended after the initial 3 months. Please advise.

Termination and Compensation

Termination is not necessarily a negative outcome. If you are terminated, the company is obligated to provide you with notice pay and retrenchment compensation equivalent to 20 days' salary.

Since you are an engineer falling under the staff category, you will be governed by the Terms & Conditions stated in your appointment letter. Asking you to resign may be related to concerns about your performance or the sharing of your profile with others. In the event of termination, you will receive a salary for the stipulated period or be required to serve the notice period as specified.

Since the company has already made a decision, there is no point in staying with the company. Start searching for a new job and simultaneously ask for time from your present employer. Leave the company once you secure another job. There is no point in wasting time with your current employer.

There is no reason to stay with them if they have decided to terminate you. It's better to look for a new job. Congratulations in advance on your new job.

Send me your CV. Your profile says you are from Karachi. If that is so, I can help you out with good job opportunities. Leave the company that doesn't care about you. Tell them to terminate you with a proper FFS (full and final settlement). NEVER resign in such a scenario!
