Are Probationary Employees Entitled to Leave Under the Punjab Shops Act? Seeking Guidance from Seniors

rajni.stitch
Dear Seniors, Our company falls under "The Punjab Shops and Commercial Establishments Act, 1958". Are employees on probation liable for any type of leave such as Earned Leave (EL), Casual Leave (CL), or Sick Leave (SL)? My company policy is silent on this matter.

It all depends on the company policies. In my knowledge, no leave is granted under probation except Casual Leave (CL). However, advance Privilege Leave (PL) is considered depending on exigencies.

Leave Entitlements Under The Punjab Shops and Commercial Establishments Act, 1958

For Casual Leave and Sick Leave, kindly refer to "The Punjab Shops and Commercial Establishments Act, 1958," Section 14(4).

"Notwithstanding anything contained in the foregoing sub-section, every employee in an establishment shall be allowed with wages seven days of casual leave and seven days of sick leave in a year."

On the other hand, the entitlement of Earned Leave (EL) depends upon the company policy.

The first thing is that you have to go through the leave rules mentioned in the Factory Act and THE PUNJAB INDUSTRIAL ESTABLISHMENT (NATIONAL AND FESTIVAL HOLIDAYS & CASUAL AND SICK LEAVE) ACT, 1965 (6.1 – 6.6) (Punjab Act 14 of 1965) for complete details and eligibility.

Well, you also can understand that these CL & SL are necessary needs for everyone, and every employee who is working for 8 hours a day, whether on probation or a regular employee, can avail and is eligible.

Also, I have attached two documents for your further perusal.

Comment posted by you is misleading. You cannot decide company policies contrary to legal provisions. The query posted is about specific legal provisions applicable in the state of Punjab, and one must comment on it only if he or she knows the relevant provision.

Applicability of Acts to Shops and Commercial Establishments

- The Factories Act is not applicable in this case since the query is about shops or commercial establishments.
- The Punjab Industrial Establishment National & Festival Holidays & Casual & Sick Leaves Act is also not applicable here. The definition of Industrial Establishment given in the Act does not cover shops and establishments.
