How can I withdraw my Provident Fund (PF) without the signature of my employer? He has refused to sign the form. Also, could you please provide me with the PF withdrawal form?

When an employer refuses to sign the forms, you can obtain a signature from a Gazetted Officer or Government Doctor on the forms and submit them directly to the PF office with the required information. The forms required are 10C and 19.

Second, no one can stop you from withdrawing your EPF amount, but you also need to realize what you did and why you are having this problem with your employer.

Third, I want to inform you that to withdraw your EPF amount, you don't just need to have your EPF form signed by your employer, but you also need the Employer ID/registration code on this form, duly stamped and attested by the Employer/Authorized Signatory, which is a statutory/legal requirement. Without this, the EPF office will not accept your withdrawal form, and you need to keep this in mind.

The reason behind the refusal to sign my EPF form by the G.M is that the HR Manager denies receiving any notice period. Even though I gave her a one-month notice by writing her a letter, I do not have any receipt of that. So, she made the amount payable on my side and said if I want my full and final settlement, then I should pay that amount.

I do not want to pursue legal action as you suggested filing a complaint with the labor commissioner because you are aware of the lengthy procedures they follow, and I cannot take time off regularly for it.

I am now providing you with an easy way to proceed without any legal action. Just fill up the PF withdrawal form with your name, your father/husband's name, your EPF number, your date of joining, date of leaving, and date of birth. Also, provide your bank account number and bank address. Write a simple letter stating that the employer refused to sign the EPF form and send it to the Regional Provident Office or PF Commissioner in your area.

Within 15 days, the commissioner will send this form to your local EPF office enforcement officer. The officer will visit the factory, and the employer will surely sign your EPF form. The enforcement officer will then submit it to the commissioner's office, and within 20 days, you will receive your EPF and FPF amount in your bank account.
